Contractor vs EOR employee: what’s the difference?

A contractor is an independent professional you engage for project-based or flexible work — they invoice you and handle their own taxes and benefits. An EOR (Employer of Record) employee is a permanent team member where a local legal employer hires them on your behalf, handling payroll, statutory contributions, and benefits. When you bring on talent, there are two fundamentally different ways to engage them: as a contractor or as a full-time employee through an Employer of Record (EOR). The right choice affects how the person is paid, who handles taxes and benefits, and your compliance obligations.

What’s a contractor?

A contractor is an independent professional you engage for project-based, flexible, or ongoing work. They run their own business and work with you under a service agreement.

  • They invoice you for their work (hourly, milestone, or fixed-fee).
  • They are responsible for their own taxes and their own benefits.
  • They typically control how and when they deliver the work.
  • The relationship can be ended per the terms of the contract.

What’s an EOR employee?

EOR stands for Employer of Record. With EOR, a local legal entity formally employs the worker on your behalf in their country, while the person works for your team day to day. This lets you hire a permanent employee somewhere you don’t have your own legal entity.

  • The worker is a full-time employee, not an invoicing contractor.
  • The Employer of Record handles payroll, statutory contributions, and benefits required by local law.
  • Employment protections and obligations follow local employment law (notice, leave, contributions).

  • How they’re paid — Contractor: submits invoices. EOR: runs through payroll as net salary.
  • Taxes — Contractor: self-managed. EOR: withheld and remitted by the employer.

  • Best for — Contractor: flexible, project-based, or short-term work. EOR: long-term, dedicated roles where you want a permanent employee.

How to choose

Pick the model that matches the actual working relationship — not just whichever is faster to set up:

  • Choose a contractor for flexible, project-based, or specialized work where the person operates independently.
  • Choose an EOR employee for a long-term, dedicated role where you want a permanent team member with benefits and full local compliance.

Warning: Classifying someone as a contractor when the relationship looks like employment (fixed hours, full-time, heavily directed work) can create compliance and tax risk in many countries. When in doubt, choose the model that reflects how the person actually works.

  • Full Time Employee — marked Coming soon. EOR hiring isn’t open for self-serve yet, so this option can’t be selected at the moment.
